Expertise
Jenna is a national and cross discipline restructuring Senior Associate with expertise in transactional and contentious corporate insolvency work and in personal insolvency matters. Jenna has developed a particular expertise in dealing with complex insolvency litigation cases.
Jenna is regularly instructed by Insolvency Practitioners, creditors and directors to offer advice and assistance with a range of matters including pursuing and defending claims under the Insolvency Act 1986 (such as misfeasance, transactions at undervalue, preference) and assisting with the recovery of company assets. Jenna also regularly advises directors in respect of their duties and liabilities. Jenna has played a key role in the successful reported cases that the team have been instructed on in the High Court and Supreme Court.
Whilst the majority of Jenna’s work stems from corporate insolvencies, she also advises in relation to personal insolvency matters, often acting for trustees in bankruptcy or individuals that may be facing bankruptcy.
Jenna is a committee member of the Manchester NextGen arm of the Turnaround Management Association.
Experience
- Acting for the Administrators of a failed energy company and advising them as to potential Insolvency Act claims that may be pursued.
- Acting for the Administrators and subsequent Liquidators of a large construction company and advising them on potential Insolvency Act claims that may be pursued.
- Assisting on the supreme Court case of Bilta (UK) Ltd (In Liquidation) v Nazir & Others [2015] 2 W.L.R. 1168.
- Acting on behalf of the liquidator of a leading flooring retailer in successful committal proceedings against the former directors of the company in the course of winding-up proceedings (Nixon & Hope Limited (in Liquidation) [2015] EWHC 2931 (Ch)).
- Advising and actively pursuing claims on behalf of the liquidators of a payroll company which had engaged in a £40m VAT fraud.
- Working as part of the team acting on behalf of a liquidator in pursuing substantial claims against a leading financial institution in relation to their participation in Missing Trader Intra-Community (MTIC) Fraud.
- Advising individuals who are faced with a Statutory Demand or Bankruptcy Petition.
