Fay has over 30 years’ experience in the housebuilder sector. She acts for national housebuilder clients in relation to management company agreements on site set up, the transfer of managed land on the completion of sites and infrastructure agreements/ deeds/ transfers for matters arising before and during site development.
The management agreements establish the legal arrangement for managing the site between the developer and the managing agent. The managed land transfers ensures the ongoing maintenance of amenity land on completion of the site. The infrastructure agreements/ deeds/ transfers provide for the laying and future maintenance of roads, sewers, and utility services that serve the developments.
Fay also has technical expertise in plot sales, part exchanges, site set up, and miscellaneous post completion enquiries.

I help my housebuilder clients by delivering my legal expertise in a timely manner by focusing to understand the objectives of the job, the timescales involved, identifying as soon as possible any obstacles and dealing with issues quickly to achieve the set timescales whilst avoiding any delays with plot sales.
Experience
- Acting for housebuilders in drafting and advising on management agreements and negotiating these.
- Acting for housebuilders drafting and completing transfers of amenity land to management companies and dealing with all property aspects of the handover of the management company to the residents.
- Managing a team of paralegals and apprentices in the timely progression of infrastructure agreements including sub-station transfers, pumping station transfers, deeds of easements for water, gas and electricity, Section 38 Agreements for the adoption of roads, Section 104 Agreements for the adoption of sewers and SUDS.
- Managing a team of paralegals and apprentices dealing with an array of post-completion enquiries, including dealing with the compliance and/ or removal of restrictions and notices appearing on titles of historical plots.
